Forensic Accountant Expert Witness Services - Brand Licensing Dispute - Demonstrating material overstatement of a counter - claim for financial losses

In a licensing agreement dispute, the proprietor of a leading consumer brand, claimant in proceedings at the High Court, faced a counterclaim for substantial financial losses for alleged early termination of the agreement in breach of its terms. To address the complex counterclaim and particularly the amount of the losses claimed, the law firm acting for the claimant appointed as expert witness an experienced forensic accountant in our Forensic Services team.

Having considered the case papers and evidence obtained, our expert produced an expert witness report for the proceedings. The information obtained included details of past and variously projected trading and financial performance nationally and internationally. The report presented our expert’s opinion on the issue of the amount of the losses claimed together with detailed analyses and reasoning. It demonstrated that the amount claimed, supported by the evidence of the expert accountant for the defendant, was materially overstated. 

Following the Meeting of Experts and the subsequent Joint Statement of Experts, the matter was settled. The claimant succeeded in achieving a favourable outcome avoiding the costs and uncertainties of a trial.
